The Republican Party of Texas calls upon the Texas Legislature to:

1. Limit judicial, prosecutorial, and official immunity to lawful, good-faith actions only;

2. Deny immunity where a public official:

• Violates constitutional rights

• Acts outside lawful authority or jurisdiction

• Fails to follow mandatory law or procedure

• Withholds or falsifies evidence

• Retaliates against individuals asserting their rights

3. Eliminate the use of “discretion” as a defense when constitutional rights are violated;

4. Create a clear civil cause of action allowing Texans to seek damages and relief when harmed by unlawful government conduct;

5. Ensure courts apply an objective standard, based on law—not subjective intent—when evaluating immunity claims. We ask that copies of this resolution be transmitted to members of the Texas Legislature and relevant state leadership.
